We will not be liable, directly or indirectly, for any loss, damage, or offence arising from your use of, or reliance on, these external websites or resources, including their privacy practices or content. You use them at your own risk.


 

8. Orders, Shipping & Prepared-to-Order Items

Overview

Prepared-to-order items are produced, packaged, or decanted specifically for each order. These items are non-refundable and non-cancelable, except in cases of proven defect, damage, or incorrect fulfillment.

All raw materials, aroma chemicals, essential oils, diluted materials, and related products supplied via the Website are prepared strictly on a made-to-order basis. We purchase materials in bulk form and only decant, measure, dilute, package, and label products after receipt of a confirmed customer order.

By placing an order, you expressly acknowledge that your goods are custom-prepared specifically for you.

Production is deemed to commence immediately upon order processing.

Accordingly, all prepared-to-order items constitute goods made to the customer’s specifications within the meaning of applicable consumer legislation and are exempt from cancellation rights once preparation has commenced.

Orders cannot be cancelled due to change of mind. No amendments to shipping method, packaging, or order content are permitted after submission.

Customer Responsibility

By purchasing, you assume full responsibility for:

  • Verifying the correct material, concentration, dilution ratio, and packaging prior to purchase

  • Handling, storage, transport, use, and disposal of all materials

  • Compliance with all applicable chemical, safety, and labelling laws

  • Engaging a fully qualified assessor, such as a member of the Royal Society of Chemistry (RSC) or the British Toxicology Society (BTS), where regulatory or legal compliance is required to place finished products on the market.

Customers acknowledge that natural variation, oxidation, colour change, crystallisation, sediment, or batch variation does not constitute a defect.

Materials may be supplied pure or diluted as specified in the product listing.

Customers acknowledge that all chemical raw materials supplied are handled, stored, and used at the customer’s own risk once delivered. We have no visibility or control over storage, handling, or use, and cannot guarantee safety, quality, or suitability for resale, including but not limited to exposure to heat, light, moisture, contamination, oxidation, or other environmental or handling-related factors. Under UK chemical legislation, including REACH , CLP, and COSHH, suppliers cannot resell raw chemicals once delivered due to obligations around safe handling, traceability, and hazard communication.

Order Acceptance

All orders are subject to acceptance and availability.

An automated acknowledgment does not constitute acceptance.

A legally binding contract is formed only upon dispatch of the goods. Payment authorisation does not constitute acceptance or create a binding contract.

We reserve the right to cancel orders prior to dispatch in cases of stock errors, mispricing, verification concerns, or regulatory restrictions, with a full refund issued where applicable.

Accordingly, all prepared-to-order items constitute goods made to the customer’s specifications within the meaning of applicable consumer legislation and are exempt from cancellation rights once preparation has commenced. Any statutory right to cancel or request a refund expires 14 days after delivery, regardless of whether a customer claims they cannot use the products legally.

Shipping & Delivery

Shipping, delivery risk, damage in transit procedures, timeframes, and related matters are governed by our Delivery Policy, which is incorporated into these Terms.


 

9. Product Documentation (SDS, CLP, Allergen, IFRA, Annex VIII / PCN etc.)

Documentation Supply Policy

All documentation is supplied strictly in accordance with our Documentation Supply Policy, which is incorporated into these Terms.

Definition of Documents

Where the terms “Documents” or “Datasheets” are referenced on product pages, they refer specifically to Safety Data Sheets (SDS) only.

SDS are supplied in accordance with applicable UK REACH and GB CLP requirements and are provided primarily for CLP classification and safe handling purposes.

SDS do not constitute a full regulatory compliance pack and may not contain the compositional detail required for Annex VIII / Poison Centre Notification (PCN) submission.

Availability & Limitations

Documentation is made available only where supplied to us by upstream manufacturers or distributors.

Additional documentation (including but not limited to Certificates of Analysis (CoA), IFRA Certificates, Allergen Declarations, Annex VIII / PCN composition data, or other regulatory documentation) is provided only where explicitly stated and where made available by the manufacturer.

We do not accept any claims for missing documentation that was not provided at the time of purchase or made available on the product page. Customers are responsible for verifying availability prior to purchase.

There is no legal obligation for us to supply such documentation, and availability cannot be guaranteed.

Purchases cannot be cancelled or refunded on the basis that additional documentation is unavailable.

All Safety Data Sheets (SDS) constitute the primary regulatory documentation and can be downloaded from the customer’s online account. Additional documentation (Certificates of Analysis, IFRA Certificates, Allergen Declarations, Annex VIII / PCN composition data) is provided only if explicitly stated and available from the manufacturer. Purchases cannot be cancelled or refunded on the basis that additional documentation is unavailable.

Supplier Role and Customer Responsibility

Perfume Extract’s role is strictly limited to supplying raw materials and, where available, providing Safety Data Sheets (SDS) for informational purposes. We do not certify, approve, or assume any liability for the regulatory compliance, safety, or suitability of finished products formulated using these materials. Customers are solely responsible for ensuring that all products they manufacture, distribute, or sell comply with applicable laws and regulations, including but not limited to chemical, cosmetic, labeling, and safety requirements. Where required, customers must engage appropriately qualified professionals, such as members of the Royal Society of Chemistry (RSC) or the British Toxicology Society (BTS), to perform regulatory, safety, or compliance assessments.

Customer Responsibility

If you require documentation for regulatory, cosmetic safety assessment, PCN notification, or other compliance purposes, you must verify availability prior to purchase.

No reliance may be placed on informal communications, including verbal statements, chat messages, or unverified emails, regarding documentation; only information confirmed on the relevant product page and within the Documentation Supply Policy at the time of purchase constitutes official documentation supplied.

Customers are solely responsible for determining regulatory suitability of materials for their intended use.

Customers are also responsible for ensuring that any regulatory, cosmetic safety assessment, PCN notification, or other compliance work is carried out by a fully qualified assessor, such as members of the Royal Society of Chemistry (RSC Membership) or the British Toxicology Society (BTS Membership). Failure to appoint a fully qualified assessor, or to ensure regulatory compliance, does not create liability for the products or the documentation supplied.

 

Supplier Role and Customer Responsibility

Perfume Extract’s role is strictly limited to supplying raw materials and, where available, providing Safety Data Sheets (SDS) for informational purposes. We do not certify, approve, or assume any liability for the regulatory compliance, safety, or suitability of finished products formulated using these materials. Customers are solely responsible for ensuring that all products they manufacture, distribute, or sell comply with applicable laws and regulations, including but not limited to chemical, cosmetic, labeling, and safety requirements. Where required, customers must engage appropriately qualified professionals, such as members of the Royal Society of Chemistry (RSC) or the British Toxicology Society (BTS), to perform regulatory, safety, or compliance assessments.

 


 

10. Price and Payment

  • All prices are in £ GBP.
  • We reserve the right to change prices at any time without notice.
  • Payment can be made by major credit/debit cards or PayPal. Payment will be taken and cleared before dispatch. 
  • Only one discount code may be applied per order. 
  • If a pricing error is identified before an order is accepted, we may notify you and provide the option to either confirm the order at the correct price or cancel it. Any payments for cancelled orders will be fully refunded.

 

11. Eligibility to Purchase

By placing an order, you represent, warrant, and agree that you:

  1. Legal Age: are at least eighteen (18) years of age if acting in an individual capacity;

  2. Accurate Information: have provided complete, current, and accurate information, including your full name, address, telephone number, email address, and any other requested particulars; and

  3. Professional Competence: represent, warrant, and agree that you are a fully trained and qualified industry professional, competent to safely handle, store, transport, and use the products offered. This includes understanding the use of pure and diluted materials, CAS identification, and SDS documentation. Where regulatory or legal compliance is required to place finished products on the market, customers must engage a fully qualified assessor, such as a member of the Royal Society of Chemistry (RSC) or the British Toxicology Society (BTS).

  4. Documentation Responsibility: All Safety Data Sheets (SDS) constitute the primary regulatory documentation supplied and can be downloaded from your online account. Additional documentation (Certificates of Analysis, IFRA Certificates, Allergen Declarations, Annex VIII / PCN composition data) is provided only where explicitly stated and made available by the manufacturer. We do not accept any claims for missing documentation that was not provided at the time of purchase or made available on the product page. Customers are responsible for verifying availability prior to purchase.

We reserve the right, at our sole discretion, to refuse or cancel any order if you do not meet these requirements. Any contract formed in breach of these representations and warranties shall be voidable by us.


 

12. Offers and Promotions

Redeeming Promotional Codes

  • Valid promotional codes must be entered at the time of checkout on the initial order.

  • Each code may be redeemed once per person and is valid only for online purchases at www.perfumeextract.co.uk

  • Codes cannot be combined with other promotions or discounts, applied retrospectively, or exchanged for cash.

  • Gift vouchers and sale items are excluded from promotional offers.

Free Gifts and Offer Limits

  • Certain promotions may include a complimentary gift when order criteria are met.

  • Only one free gift per offer is permitted; multiple free gifts of the same item are not allowed.

  • Free gifts are subject to availability.

  • We reserve the right to refuse or cancel orders where codes are invalid or the number of free items exceeds the offer limit.

Changes and Withdrawals

  • All promotions, including discount codes and offers, may be modified, suspended, or withdrawn at any time without prior notice.

  • Discount codes or loyalty points will not be applied retrospectively.

Abuse of Promotions

  • Any intentional misuse of promotional codes, including manipulation of browser or system functionality, fraudulent activity, or breach of these terms, may result in account suspension or a ban and the cancellation of outstanding or future orders.

Spring Scent Celebration Promotion

The Extra 15% off orders over £100 promotion (code SPRING15) is open to UK customers only and ends at 23:59 on 31st March. A minimum spend of £100 applies. Kits and gift cards are excluded. Offers are subject to availability and may be withdrawn without notice. No cash alternative is available. By using this promotion, customers agree to these terms.

  • Regulatory compliance, safety, or legal status of any finished product formulated using our raw materials.

Direct Damages

Our total liability for direct loss or damage shall not exceed the amount paid for the product or service giving rise to the claim.

Exclusions

Nothing in these Terms limits or excludes liability for:

  • Death or personal injury caused by our negligence;

  • Fraudulent misrepresentation; or

  • Any liability which cannot be excluded under English law.

Third-Party Services

We accept no liability for losses arising from your use of third-party services, websites, or delivery providers.

Customer Responsibility

You are solely responsible for the safe, lawful, and appropriate use, handling, storage, transportation, formulation, and application of all products and materials obtained through the Website or our services.

We shall not be liable for:

  • Claims arising from subjective fragrance perception;

  • Claims relating to colour variation, oxidation, or normal chemical instability;

  • Claims for return or rejection of goods that were prepared in accordance with the order specifications provided at checkout.

You acknowledge that all chemical raw materials supplied are made-to-order, non-resalable, and delivered into your possession at your risk. Any statutory right to cancel or request a refund under UK consumer law expires 14 days after delivery, regardless of any claim that the goods cannot be used legally.

We shall not be liable for the regulatory compliance, safety, or legal status of any finished product formulated using our raw materials.

 


 

18. Severance

If any part of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed, and the remaining provisions shall continue in full force and effect.


 

19. Waiver

Failure to enforce any Term does not constitute a waiver of future enforcement.


 

20. Entire Agreement

These Terms, along with our Privacy, Cookie, Delivery, Documentation Supply, and Cancellations & Returns Policies, form the complete agreement between you and us.


 

21. Law and Jurisdiction

These Terms shall be governed by English law; disputes resolved exclusively in English courts.
