The Website may only be used for lawful purposes and in a lawful manner. You agree to comply with all applicable laws, statutes and regulations regarding the Website and its use. You agree not to upload or transmit through the Website: You agree to fully indemnify, defend and hold us, and our officers, directors, employees and suppliers, harmless immediately on demand, from and against all claims, losses, costs and expenses, including reasonable legal fees, arising out of any breach of these Terms by you, or any other liabilities arising out of your use of this Website or any other person accessing the Website using your personal information. As a convenience to our customers, the Website may include links to other websites or material which is beyond our control. For your information, we are not responsible for such websites or material nor do we review or endorse these. We will not be liable, whether directly or indirectly, for the privacy practices or content of such websites nor for any damage, loss or offence caused or alleged to be caused in connection with, the use of or reliance on any such advertising, content, products, materials or services available on such external websites or resources. All orders are subject to acceptance and availability. If the goods ordered are not available, you will be notified by e-mail (or by other means if no e-mail address has been provided) and you will have the option either to wait until the item is available from stock or to cancel your order. Any orders placed by you will be treated as an offer to purchase the goods or services from us and we have the right to reject such offers at any time. You acknowledge that any automated acknowledgment of your order which you may receive from us shall not amount to our acceptance of your offer to purchase goods or services advertised on the Website. The conclusion of a contract between you and us will take place when we (i) debit your credit, debit card or PayPal account or (ii) dispatch the goods to you or commence the services, whichever is the later. We will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be liable for any loss you may suffer if a third party procures unauthorised access to any data provided by you when accessing or ordering from the Website. We may send multiple orders received at the same time in one package or send your order in more than one package if some items are not in stock or on back order. Perfume Extract accepts no liability for loss of an order, where the customer requests that their order be left in a safe place, communal area or with a neighbour in the event that there is no one at the customer shipping address to accept delivery. EU, International & Overseas Orders Our raw ingredients and materials, particularly those that fall into the Hazardous Shipping Category can only be shipped to destinations in the UK. Shipping costs vary from country to country. Overseas orders may be subject to customs charges. EU, International & Overseas orders are sent DDU (Delivered Duty Unpaid) meaning you may be liable to pay import duties on your products. It is the sole responsilibity of the customer to ensure that they have checked for any applicable customs laws and are prepared for any additional costs that may apply when importing items. Any customs duties, VAT or other charges incurred due to EU, international and overseas shipping are the sole responsibility of the customer. Please check with your country’s laws and regulations for details of any customs duties and/or charges that may apply prior to placing an order. We reserve the right to cancel any order and offer a full refund if we cannot find a suitable shipping solution for your destination. We reserve the right to cancel any order in part or in full and offer a full or partial refund if the order contains hazardous goods, such as solvents and perfumers alcohol etc. Third Party Shipping Providers We accept no liability for loss, where you ‘the customer’ requests that your order be delivered to any overseas shipping provider and/or any other third party shipping service provider, such as GGBG, save for where our chosen carrier fails to fulfil delivery of the goods to such overseas/third party shipping service provider’s address in the UK in the first instance. You agree that your parcel has been accepted by you upon delivery to the service provider address when it is confirmed by our carrier as ‘delivered’ to the delivery address as specified by you in the order confirmation. Full details of our shipping, overseas shipping (inc. customs) and delivery terms are set out in a seperate delivery policy, which can be found here. By accepting these terms, you also agree to be bound by and accept the terms of delivery. Prepared to order materials include all fragrance oils, essential oils, aroma chemicals and any other perfume making related materials and ingredients. To keep costs at a minimum, such materials will be sent in a combination of PET and/or HDPE bottles. If however, you require your materials to be sent using glass and/or aluminium vessels or containers, you must request this prior to placing an order; at which time we will advise you on the options available for the materials being purchased and provide instructions on how you can add the upgraded bottle and shipping surcharge to your order. Orders for such materials are specifically prepared to order, which means; we don’t accept returns for fragrance oils, essential oils, absolutes, tinctures, aroma chemicals and any other perfume making related materials and ingredients orders, unless there is something wrong with the material or ingredient in question. If you have a problem with a prepared to order material, please contact us in the first instance. Documentation for materials/products and ingredients (where available) will be provided via download from the corresponding product page only. Important: Our products (perfume and candle making materials and ingredients) do not come with instructions on how to use them and are sold on the understanding that the purchaser has a suitable knowledge and/or understanding of how to use such raw materials, products and ingredients competently. Whilst we will endeavour to add documentation to the website under the datasheets tab, if the documentation isn’t readily available, it may be because we are unable to supply it. In which case the materials and ingredients that are listed without a link to any data sheets are sold on a purely educational and evaluation basis only and you agree to receive such materials and ingredients for that sole purpose. Therefore, if you intend to bring to market finished products using any of our raw materials, products and ingredients and are likely to require a cosmetic safety assessment for the purpose of obtaining a cosmetic product safety report or similar, then you accept that it is your sole responsibility to check each product prior to purchase as to the availability of a data sheet and if no data sheet is available then you agree to enquire as to the availability of such data sheet/s in writing to us and wait until a satisfactory response has been received by us before proceeding to purchase the intended products to avoid disappointment. We accept no liability for any loss whatsoever where you (the buyer) purchases any raw materials, products and ingredients where the corresponding safety data sheet is not available or has not been made available as a download via the website, including; but not limited to: SDS/MSDS, CLP, Allergen, IFRA, particularly in cases where no contact is made by you to us in relation to the supply of data sheets or you make contact with us, but did not wait until you received a reply from us prior to purchase relating to the status of a data sheet or contact and requests for data sheets is submitted to us by you after you have made a purchase. In the case of IFRA, we do not provide IFRA Certificates for raw materials. IFRA Certificates are the responsibility of the perfumer creating the finished products. By accepting these terms, you agree to be bound by and accept our documentation supply policy terms as set out here We supply essential oils as cosmetic ingredients and are not required to provide warnings about their topical or therapeutic uses. If you intend to use our essential oils for any purpose other than as a cosmetic ingredient, please seek professional advice for relevant information; particularly with regard to safety, prior to use and consider correctly labeling your products based on their intended use. All prices are in £ GBP Pounds Sterling. All prices are correct at the time of entering the information onto the system. We reserve the right, however, to change prices at any time without notice to you. Payment can be made by any major credit or debit card or by Paypal. Payment will be debited and cleared from your account before the dispatch of your goods or the provision of the service to you. In the unlikely event that the price shown on the checkout page is wrong, and we discover this before accepting your order, we are not required to sell the goods to you at the price shown. We always try and ensure that the prices of goods shown on our website are accurate, but occasionally genuine errors may occur. If we discover an error in the price of the goods that you have ordered we will let you know as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If you cancel your order and you have already paid for the goods, then you will receive a full refund. You confirm that the credit or debit card that is being used is yours. All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to or does not, for any reason, authorise payment to us we will not be liable to you for any delay or non-delivery. You may only use one discount code with each order. We reserve the right to reject or cancel any orders where one or more discount codes are added to the basket. No cash alternative is available. These offers exclude the purchase of Gift Vouchers and sale items. Such promotions entitle you, at the time of ordering, to a saving on a new product or to qualify to receive a free product that may from time to time be offered as part of a promotion when an order is placed through the website. Free gift promotions are capped at one free gift per offer. Multiple free gifts of the same item are not permitted and any free gifts are sent subject to stock availability at the time of ordering and only one free gift per offer will be sent providing the order value threshold for the offer has been met. We reserve the right to decline to accept orders where, in our opinion, a promotional code is invalid for the order being placed or the number of free items exceeds the value of one free item per offer unless stated otherwise.
